Mistaken identity leads to custody
At long last, Abdul Aziz of Chowgachha in Jashore, wrongly imprisoned in a case of dacoity, has been released from jail, reports UNB.
He was released on Tuesday night from Jashore central jail as Chowgachha police and Singhojhuli UP Chairman Ibrahim Khalil Badal submitted a report mentioning that the arrested Abdul Aziz was not the actual accused in the dacoity case – even though they share the same name. The accused Abdul Aziz in the case is living abroad.
After submission of the report, the innocent Abdul was produced before the court of Shahadat Hussain, Chief Judicial Magistrate of Jashore. Different matters, mostly to do with establishing his identity including his name, address and profession were enquired about.
Later, the opinion of advocate Shahanur Alam Shaheen, former general secretary of Jashore Lawyers Association, was sought as Amicus Curie (friend of the court). He was also the counsel for the real accused Abdul Aziz in the case.
Advocate Shaheen confirmed to the court that the detained Abdul Aziz was not his client, nor the real accused in the case. The innocent Abdul was detained due to a gaffe by the police, he added.
Thereafter Abdul was freed from jail after the court order reached the jail. Advocate Shanur Alam Shaheen and nephew of Abdul confirmed the release to UNB. Abdul spent a total of 9 days in jail.
